Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.
3. Service Description
Spark Roam Limited provides a platform for the purchase and management of international eSIM data plans. Our Services include, but are not limited to:

4. User Responsibilities

Ensure that your device is eSIM-compatible before purchasing a plan. Spark Roam Limited is not responsible for plans purchased for incompatible devices.

Use the Services for lawful purposes only and in compliance with all applicable laws and regulations of England and Wales and the country of use.

Not resell, transfer, or assign the eSIM or Data Plan to any third party.

Be solely responsible for any data overages, roaming charges, or other fees incurred from a carrier, unless such fees are specifically part of the purchased Data Plan.
5. Pricing, Payments, and Refunds

Pricing: All prices are listed in GBP (£) and are subject to change without prior notice. Prices are inclusive of VAT where applicable.

Payment: We accept payment through [List of Payment Methods, e.g., credit cards, PayPal, Apple Pay]. All payments are processed through a secure third-party payment gateway.

Refunds: Our Refund Policy is detailed on a separate page. This policy does not affect your statutory rights as a consumer under UK law. Generally, refunds are only issued if the eSIM is proven to be defective and has not been installed or used. No refunds will be provided for purchased plans that have been activated or used.
6. Service Provision and Activation

Upon successful payment, you will receive an email with your eSIM QR code or activation details.

Activation requires a stable internet connection. It is the User’s responsibility to have this connection to install the eSIM.

Spark Roam Limited guarantees that the eSIM will be active for the specified duration from the moment it connects to a supported network.
7. Limitation of Liability
Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by the law of England and Wales.
Subject to the preceding paragraph, Spark Roam Limited, its affiliates, and their respective officers, employees, and agents will not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses resulting from:

Statements or conduct of any third party on the Services.

8. Intellectual Property
All content on the Spark Roam Limited website, including but not limited to text, graphics, logos, images, and software, is the property of Spark Roam Limited or its content suppliers and is protected by UK and international copyright, trademark, and other intellectual property laws.
9. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the law of England and Wales. You and Spark Roam Limited agree that the courts of England and Wales will have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or their subject matter or formation.
10. Termination
We reserve the right to suspend or terminate your access to the Services at our sole discretion, without notice, for any reason, including but not limited to a breach of these Terms.
